Fines for spitting, smoking, littering, dog walking, nude bathing, etc. will be introduced in Sanya, Haikou and Hainan from January 1, 2021

Hainan has introduced the Rules for the Promotion of Civilized Conduct in Hainan Province (hereinafter referred to as the Rules), which were adopted at the 23rd meeting of the Standing Committee of the Sixth People's Congress of Hainan Province, but will be formally enacted on January 1, 2021. Since the Rules have been enacted, penalties for uncivilized behavior such as spitting, grabbing a seat, swimming naked on public beaches, walking a dog without a rope, and other uncivilized behavior have more specific penalties.


The "Rules" is the first special regulation to promote civilized behavior in Hainan Province, China. They set out the basic principles for the promotion of civilized behavior, norms of civilized behavior, incentives and rewards, performance guarantees and legal responsibility, and clearly list civilized models of behavior that citizens must adhere to.


It is worth noting that the "Rules" specify that for uncivilized behavior that violates these rules, the "Law of the People's Republic of China on Punishments for Managing Public Security" and other relevant laws and regulations providing for administrative sanctions, the relevant law enforcement agencies will punish them in compliance with the law and apply them many times. Uncivilized behavior is strictly punishable by law.


The Regulation also clarifies the rules of punishment for uncivilized behavior, for example, those who are in public places without a shirt will be ordered to get dressed; those who refuse will be fined at least 50 yuan but not more than 200 yuan; those who go naked or bathe naked on public beaches and public baths should be ordered to make corrections; those who refuse to make corrections should be fined 200 yuan; anyone who makes a loud noise in public places can be fined 50 to 200 yuan.


Anyone who spat, spat out betel nut juice, spat gum, defecated, or threw away trash will be ordered to be removed and fined 50 yuan.


People who smoke (including e-cigarettes) in closed public places, public transport, schools, kindergartens, medical and medical institutions and other special places are ordered to make corrections and a fine of 50 yuan; if they refuse to make corrections, they should be fined over two hundred yuan.
