Beijing woman could be prosecuted for stealing someone else's food on delivery

Recently, in a district of Beijing, residents discovered that many food orders delivered by couriers had recently gone missing, so they called the police.


After checking the CCTV cameras, the police found that a young woman took someone else's food for herself. The police quickly identified and apprehended the suspect, and after the police interrogated the woman, they learned that the woman actually graduated from a prestigious school and now has a high-paying job as an office worker.


The woman also confessed to stealing takeaway food. According to the woman, she began to steal food during the epidemic, when, due to greed, she saw delicious takeaway dishes ordered by others and took them for herself.


After she took someone else's food several times and found that no one noticed her, she gradually became addicted to this method of stealing without spending money, so from time to time she went to the express delivery shelf to pick up someone else's order.


The behavior of a woman in stealing someone else's takeaway food is an act punishable by both administrative and criminal law. According to Article 49 of the Law on Administrative Punishment of Public Security Organs, one who steals, deceives, robs, kidnaps, extorts, or willfully damages public or private property shall be punished for at least five days, and at the same time, a fine of not more than 500 yuan, in more serious circumstances - for a period of not more than 10 days, but not more than 15 days, and can be fined at the same time not more than 1,000 yuan.


And since this woman has stolen repeatedly, more than once, if the total amount of repeated theft exceeds 1000 yuan, then in accordance with Article 1 of the Clarification of the Supreme People's Court and the Supreme People's Procuratorate of China on a number of issues regarding the application of the law in criminal cases of theft, it is determined as "large amount".


Calculated according to the amount of the woman's repeated theft, it should probably exceed one thousand yuan, so she should be held criminally responsible for the crime of "large sum" theft. Pursuant to Article 264 of the "Penal Law of the People's Republic of China": "Whoever steals public or private property on a relatively large scale, or repeatedly steals, breaks into a house, steals with a weapon, shall be sentenced to a fixed term of imprisonment for up to three years, arrest or in case of a large amount or in the presence of other grave circumstances - shall be punished by imprisonment for a certain period of three to ten years, as well as a fine, and in case of an especially large amount or in the presence of other especially grave circumstances - shall be punished by imprisonment for a term of up to ten years or life imprisonment freedom with a fine or confiscation of property.


The specific responsibility of the woman depends on the amount of food stolen from the express delivery.
